Terms of Service

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you ("Purchaser") and Peptide Foundry LLC ("Company") governing access to peptidefoundry.com (the "Site") and purchase of products. By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, you must not use the Site or purchase products.

2. Research Use Only — Intended Use Restrictions

2.1 Product Classification

All peptides and related materials sold by Peptide Foundry ("Products") are classified as Research Use Only (RUO) chemicals, intended solely for in-vitro laboratory research conducted by qualified researchers. Products are NOT drugs, biologics, medical devices, or dietary supplements and have not been evaluated, approved, or cleared by the FDA or any regulatory agency.

2.2 Prohibited Uses

Products shall NOT be used for: human consumption, injection, ingestion, inhalation, or any human use; veterinary or animal use; food, beverage, or dietary supplement manufacturing; cosmetic manufacturing; diagnostic purposes in humans or animals; therapeutic purposes including treatment, cure, mitigation, or prevention of disease; any clinical, medical, or healthcare application; resale to end consumers or non-research entities; or any use prohibited by law.

2.3 Purchaser Certification

By placing an order, you certify that: you are at least 18 years old and legally capable of entering binding contracts; you are a qualified researcher, scientist, or authorized representative of a legitimate research institution; you have the expertise, training, and facilities to handle research chemicals safely; Products will be used exclusively for lawful in-vitro research in a controlled laboratory; Products will be stored, handled, and disposed of per applicable regulations; you will not transfer Products to third parties for prohibited uses.

2.4 Compliance Responsibility

You are solely responsible for ensuring your purchase, possession, and use of Products complies with all federal, state, local, and international laws, regulations, and institutional policies.

3. Account Registration

An account is required to place an order. You must provide accurate, complete, and current information; maintain security of your credentials; promptly update any changes; and accept responsibility for all activity under your account. We reserve the right to refuse, suspend, or terminate accounts at our discretion.

4. Orders and Payment

Payment is processed through third-party payment processors. All prices are in US dollars and subject to change. You authorize us to charge the payment method provided for the total order amount. Orders are subject to acceptance and verification; we reserve the right to refuse or cancel any order at our discretion.

5. Shipping and Delivery

We ship within the United States only via UPS with free 2-day delivery on all orders. A physical street address is required (UPS does not deliver to P.O. Boxes). Delivery times are estimates and not guaranteed. See our Shipping Policy for complete details.

6. Refunds and Returns

Refund and return procedures are governed by our Refund Policy. In general: damaged or incorrect items must be reported within 48 hours of delivery; quality and purity concerns within 14 days; opened or modified products are generally non-refundable; and Foundry Club membership fees are non-refundable once the billing cycle has begun.

7. Foundry Club Membership

The Foundry Club is a $50/month subscription that unlocks member pricing on products. Billing is monthly. You may cancel anytime from your account; membership benefits continue until the end of the current billing period. No prorated refunds are issued for partial periods. New signups are temporarily paused.

8. Intellectual Property

All content on the Site — text, graphics, logos, product photography, trademarks, and code — is owned by or licensed to Peptide Foundry LLC and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, redistribute, or create derivative works without prior written permission.

9. Disclaimer of Warranties

PRODUCTS ARE PROVIDED "AS IS" FOR RESEARCH USE ONLY. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that Products will meet any particular research needs or produce any specific results.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPTIDE FOUNDRY'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS IS LIMITED TO THE PURCHASE PRICE OF THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR RESEARCH DELAYS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Peptide Foundry LLC and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from: your use or misuse of Products; your breach of these Terms; your violation of any law; or your negligence or willful misconduct.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Peptide Foundry LLC's incorporation, without regard to conflict-of-laws principles. Any dispute shall be resolved by binding arbitration, except for small-claims matters.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective upon posting. Continued use after changes constitutes acceptance of the revised Terms.
